TERMS AND CONDITIONS

The booking of any tour or activity organized by IBERIAN LYNX LAND S.L, will necessarily entail the prior acceptance of these Terms and Conditions, which will be considered automatically incorporated into the contract.

 

Contractual Parties

First party details. The Travel Agency IBERIAN LYNX LAND S.L, Agency Identification Code C.I.AN-237368-3, registered tourism company in Andalucia/ Spain AT/JA/00060 and Ecoturism EC/JA/00003 with CIF B23695174 and in charge of the website: ww.iberianlynxland.com

Second party details. The natural person or user who accesses the web to get information and, where appropriate, contract the services offered. This user declares that he is over 18 years of age and has the legal capacity to acquire the services offered through this website, in accordance with these Terms and Conditions, which he understands and accepts in its entirety.

With the deposit or confirmed booking of the product, the client accepts the following rights and obligations listed below.

 

Applicable law

Law 7/1998, of April 13, on general contracting conditions will also be applicable.

 

Access, registration and using the website

Access to our website is free and is conditional prior reading and express and unqualified acceptance of all of our TERMS AND CONDITIONS in force at the time of access, which we ask you to read carefully. The user at the time he uses our portal, its contents or services, expressly accepts and submits to its general conditions of use.

If the user does not agree with these conditions of use, IBERIAN LYNX LAND reserves the right to modify the presentation and configuration of this Web, expand or reduce services, and even delete it from the Network, as well as the services and content provided, all this unilaterally and without prior notice, without prejudice to respect for the rights of consumers and users that are applicable under current legislation.

 

Bookings and Prebookings

At the time of booking, 30% of the total cost of the tour will be paid, on which IBERIAN LYNX LAND will issue the corresponding receipt specifying, in addition to the cost, the information or the reference of the tour booked and the particular clauses, if any, and general clauses of the contract. The balance to be paid no later than 20 days prior to the date the tour commences. If balance payment is not made before then, IBERIAN LYNX LAND reserves the right to cancel the booking.​

When a user purchases a holiday/tour less than 20 days prior to the date the tour commences, it will be paid the total cost of the tour, without prejudice to the rights of return or refund for cancellation or other circumstance in these Terms and Conditions.

These Terms and Conditions may be nullified or modified specifically by particular conditions that concern a particular holiday. In this case, the user will be conveniently informed at the time of booking.

Payment to be made directly to Iberian Lynx Land, S. L., through a bank transfer to our account number: BBVA (BANCO BILBAO VIZCAYA ARGENTARIA).

The purchase of any product (Tour, Holiday, etc) will only be effective once the total cost of the tour is paid in a valid way, and until that moment it can be canceled by IBERIAN LYNX LAND without the user being entitled to any claim.

 

Transfer of booking

Tour participants may transfer their booking, free of charge, to a person who meets all the conditions required for it if they are prevented from proceeding with the tour the assignment must be communicated in writing to IBERIAN LYNX LAND, at least 15 days before the date of the tour commences, unless the parties agree to a shorter term. ​

The person who transfers their holiday booking and the assignee will respond jointly to IBERIAN LYNX LAND for the payment of the balance of the price of the tour, as well as the justified additional expenses that such assignment may have caused.

 

Cancellation by you before departure

At any time, the user may withdraw the services requested or contracted, having the right to a refund of the amounts that they paid, but must indemnify Iberian Lynx Land S.L., (as we incur costs from the time we confirm your booking), the following cancellation charges will be payable. Where the cancellation charge is shown as a percentage, this is calculated on the basis of the total cost payable:

1. 12 percent (12%) of the total cost of the holiday/trip, if there is a cancellation 30 days or more prior to the date of the holiday commences.

2. 30 percent (30%) between days 29 and 15.

3. 60 percent (60%) 14 days or less prior to the date of the tour commences.

4. If the client does not show up on departure, they will be required to pay the total cost of the holiday (100%), paying, where appropriate, the pending amounts.

In any case, 8% of the total cost will be paid for management and organization expenses.

the event that additional services not included in the holiday/tour have been contracted and add to the tour upon client’s initiative, the corresponding cancellation costs, if any, will be applied, always justified. In the event that the holiday/tour is subject to special economic contracting conditions, non-refundable expenses such as flights, ships, jeep permits, trekking permits and such like, or special rates, the cancellation costs will be established in accordance with the conditions agreed between the parties and current law.

Cancellation of the trip for not reaching the number of people registered the minimum foreseen

Each service has a minimum number of participants necessary to carry out the activity.

Some of the holidays we feature require a minimum number before we can operate them. The applicable minimum number depends on various factors and varies from tour to tour. Iberian Lynx Land S.L reserves the right either to cancel or to run the trip. The user will be exclusively entitled to a refund of the total cost or the amounts anticipated, and will not have the right to claim any amount as compensation, as long as the Agency has notified it in writing at least 10 days before the date of the holiday/tour commences.

 

Cancellation by us

We will not cancel your travel arrangements less than 30 days before your departure date, except for reasons of force majeure or failure by you to pay the final balance. We may cancel your holiday before this date if, e.g., the minimum number of clients required for a particular travel arrangement is not reached. If we have to make a significant change or cancel, we will tell you as soon as possible. If there is time to do so before departure, we will offer you the choice of the following options:

– (For significant changes) accepting the changed arrangements; or If we have to make a significant change or cancel, we will tell you as soon as possible If there is time to do so before departure, we will offer you the choice of the following options:

  • – (For significant changes) accepting the changed arrangements; or

  • – accepting an offer of an alternative holiday from us, of a comparable or higher standard to that originally booked if available (at no extra cost); or

  • – Where possible we will offer you at least one alternative holiday of equivalent or higher standard for which you will not be asked to pay any more than the price of the original holiday. If this holiday is in fact cheaper than the original one, we will refund the price difference. If you do not wish to accept a holiday we specifically offer you, you may choose any of our other then available holidays. You must pay the applicable price of any such holiday. This will mean you have to pay more if it is more expensive and you will receive a refund if it is cheaper.

  • – Cancelling or accepting the cancellation and accepting a full refund of all monies paid.

You must notify us of your choice within 7 days of our offer. If we do not hear from you within 7 days, we will assume that you have chosen to accept the change or alternative booking arrangements.

Please note, the above options are not available where any change made is an insignificant one.

Compensation: In addition, in appropriate cases depending on the circumstances and when the significant change or cancellation is notified to you, we will pay you compensation on the scale shown below in the following circumstances:

  • a) if, where we make a significant change, you do not accept the changed arrangements and cancel your booking

  • b) If we cancel your booking and no alternative arrangements are available.

  • The compensation that we offer does not exclude you from claiming more if you are entitled to do so.

IMPORTANT NOTE: We will not pay you compensation in the following circumstances:

– where we make an insignificant change;

– where we make a significant change or cancel your arrangements more than 70 days before departure;

– where we make a significant change and you accept those changed arrangements or you accept an offer of alternative travel arrangements;

– where we have to cancel your arrangements as a result of your failure to make full payment on time or to otherwise comply with any requirement of these Booking Conditions;

– where we have to cancel your arrangements because the minimum number of persons required to operate your holiday has not been reached;

– where the change or cancellation by us arises out of alterations to the confirmed booking requested by you;

– where we are forced to cancel or change your arrangements due to Force Majeure (see clause below).

If we become unable to provide a significant proportion of the arrangements that you have booked with us after you have departed, we will, if possible, make alternative arrangements for you at no extra charge and where those alternative arrangements are of a lower standard, provide you with an appropriate price reduction.

 

Force majeure

Except where otherwise expressly stated in these Booking Conditions, we regret we cannot accept liability or pay any compensation if our contractual obligations to you are affected by “Force Majeure”. In these Booking Conditions, Force Majeure means any event beyond our or our supplier’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include war and acts of terrorism (and threat thereof), riot, civil strife, labour strikes, significant risks to human health such as outbreak of serious disease, epidemics / pandemics, industrial dispute, natural or nuclear disaster, chemical or biological disaster, fire, floods, earthquakes, adverse weather conditions and closure or restriction of airspace or airports, the act of any government or other national or local authority, including port or river authorities, lock closure, unavoidable technical problems with transport and all similar events outside our or our supplier’s control.

 

Modifications and revisions of the conditions of the trip. Tour alteration

The tour descriptions and itineraries in brochures and on our website are meant only as a guide. Circumstance such as flight times and other uncertainties of travel may change, and the itinerary may therefore have to be changed. We will select the list of sites to visit and will organize the schedule according to the season, the time of day, the weather conditions and other variations in the environment and fauna. You will be given all the details before your trip. Iberian Lynx Land S.L. therefore reserves the right to amend the itineraries according to circumstances, but will strive to maintain the advertised standard of the tour.

In this case, and unless the parties agree otherwise, the clients may choose to terminate the contract without penalty, or accept a modification of the contract that specifies the changes and their impact on the price.

In the event that the clients do not notify their decision in the indicated terms, it will be understood that they choose for the termination of the contract without any penalty. The clients must communicate their decision to IBERIAN LYNX LAND S.L. In the event that the clients choose to terminate the contract, under the provisions, or that IBERIAN LYNX LAND

​cancels the tour before the agreed departure date, for any reason that is not attributable to the clients, they will be entitled, from the moment the contract is terminated, to the refund of all the monies paid, accordingly, or to enjoy another holiday of equivalent quality, provided that IBERIAN LYNX LAND can offer it. In the event that the tour offered is of inferior quality or is valued at a lower price, IBERIAN LYNX LAND must reimburse the clients (depending on the monies already paid) the difference, according to the contract. This same right will correspond to the clients who did not obtain confirmation of the reservation in the terms stipulated in the contract.

In the above cases, IBERIAN LYNX LAND will be responsible for the payment to the clients of the compensation that, if applicable, corresponds for breach of the contract, which will be 5 percent of the total price of the purchased tour, if the said breach occurs between the two months and fifteen days immediately prior to the date the tour commences; 10 percent if it occurs between the fifteen days and two days before the tour commences.

There will be no obligation to compensate you in the following cases:

– When the cancellation is due to the group size drops below the minimum number required to operate the tour and so is communicated in writing to the clients before the deadline set for this purpose in the contract, which will be a minimum of 10 days prior to the date of the tour commences.

– Force majeure This assumption does not include, in any case, the cancellation of a trip due to excess

Breach, liability and guarantee. Consequences of failure in providing the contracted services.

In the event that, after the tour/holiday commences, IBERIAN LYNX LAND does not supply the contracted services or cannot guarantee providing them, will offer the appropriate solutions for the continuation of the tour, without any surcharge for the user, and, where appropriate, will pay the clients the difference between the initial arrangements and the services finally provided. If the clients continue the tour with the solutions given by the organizer, it will be considered that they agree with the proposals.

 

Insurance

Iberian Lynx Land S.L. holds all the necessary insurance policies to organize, arrange and carry out nature tours and excursions, including a Surety insurance with Markel Insurance SE (Policy number 263276) (policy number 263329), for reliability and peace of mind for all of our clients and suppliers.

It is highly advisable to take out a personal travel insurance policy before leaving your country. It is a condition of booking that suitable cover be arranged by you for all destination. We will usually insist on proof of effective travel insurance cover being produced to us prior to departure, it is your responsibility to have it.

So, all members of the party booked in a holiday with Iberian Lynx Land S.L. must be fully covered by travel insurance before setting out on the holiday. This must cover you fully for cancellation by you, medical care and repatriation should you become too ill to continue your holiday, and must above all cover you against the cost of evacuation from mountainous areas if you become too ill or injured to continue. You should also note that passenger liability insurance covering the vehicles that we hire, particularly in Third World countries, may be inadequate; therefore it is important that your insurance cover makes sufficient provision for your dependants in the event of an accident. ​

Passport, visa and other documents

All users, without exception (children included), must carry their corresponding personal and family valid documentation, passport and/or ID, according to the laws of the country or countries that will be visiting l travelers must apply for their visa, passports, vaccination certificates, etc. (Iberian Lynx Land can help you in this process). In the event that the issuance of visa is rejected by any Authority, due to the user’s particular causes, or their entry into the country is denied due to lack of the requirements, or due to a defect in the required documentation, or due to lack documentation, Iberian Lynx Land declines all responsibility for events of this nature, being the clients responsible for any expenses that may arise, applying in these circumstances the conditions and rules established for cases of voluntary withdrawal of services. All users, and especially those with a nationality other than Spanish, are also reminded to ensure, before starting the holiday, that they have complied with all applicable visa regulations and requirements in order to enter without problems in all countries to be visited. Minors under 18 must carry a written permission signed by their parents or guardians, in anticipation that it may be requested by any authority.

 

About endangered species

.​The confirmed reservation of an endangered species tour (Iberian lynx, Bear, Wolf or other species that are listed as threatened and endangered), implies the client’s commitment not to reveal information or geographical location of the places/species, in order to guarantee not to disturb them and contribute to their conservation.

Behaviors that could lead to annoyance to fauna will not be allowed, and the instructions of the accompanying guide must be followed at all times.

IBERIAN LYNX LAND reserves the right to claim compensation from the offender on behalf of the injured clients or on its own behalf.

 

ANNEX. Standards for the use of our Photography Hides

For the use of hides, is needed to meet strict standards. that have to be met by anyone. Iberian Lynx Land can take legal measures in case of any infraction. Some of them could be characterized as serious, when they cause inconvenience to the fauna or may harm the interests of other clients/photographers.

  • Do not get out of the hide under any circumstances. In case of need, call the guide and wait inside until the guide get there. Then follow the instructions. . The guide will provide you the contact phone number.

  • – Do not smoke, drink alcoholic drinks and make noises that can disturb wildlife. – Speak as quietly as possible. If you have to open plastic bags or noise, do it before the animals arrive.

  • – Set up your mobile on vibration mode, and be careful with the light of the screen, since could be seen from outside and could frighten away the wildlife.

  • – Do not open the window. Cleaning the windows from inside is allowed. It is advisable to do it when there is no wildlife activity. Use only cleaning material provided by the company and follow the instructions from the person in charge.

  • – There is a trash can in the hide. Use it for all waste, with a plastic bag.

  • There is a Chemical portable W.C, in the hide. . Use it thinking that it will be used later by other photographers.

  • In case of using the toilet, be extremely careful when opening the rear door, since it limits the effectiveness of the spy glasses to avoid movements in this operation. Close it as soon as possible.

  • Once in the toilet section. Do not try to stick the head or other parts of the body to the outside.

  • Once the session is over, call the guide, who will give the appropriate instructions. Do not leave the hide without our authorization, even if no wildlife activity in the hide.

  • – If any breach of these standards is observed by the company, we reserve the right of admission for future sessions or taking legal actions that we deem appropriate.
